SYNAPSER (PTY) LTD – REPUBLIC OF SOUTH AFRICA

These Terms and Conditions apply to the Gain For Me promotional competition ("Competition") operated by Synapser (Pty) Ltd, with its registered address at Unit 5, 6 Abrey Road, Kloof, Durban, 3610 ("Promoter", "we", "us"). These Terms apply to Participants residing in the Republic of South Africa.

By entering this Competition, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

1.     IMPORTANT NOTICE TO PARTICIPANTS

In line with section 49 of the Consumer Protection Act, No. 68 of 2008, certain clauses below may limit the Promoter’s liability or require you to indemnify the Promoter. These clauses are important and include, without limitation, clauses 10, 11, 14, 15, and 16. Please read these Terms carefully.

2.     ELIGIBILITY

Only Competition entries by the following Participants will qualify as valid entries:

i.  Are legal residents of South Africa;

ii. Are 18 years or older;

iii. Possess a valid South African ID or a valid passport;

iv.  Have their own personal valid, working South African mobile number; and

 v.  Have access to a smartphone compatible with the Gain For Me App. Such smartphones must run an Android operating system limited to versions supported by the Google Play Store or an iOS operating system compatible with the App Store.

3.     EXCLUSIONS

The following persons will not qualify to win a prize:

i.  Employees, directors, or agents of the Promoter;

ii.  Merchandisers, agencies, or suppliers involved in the Competition;

iii. Their immediate family members (spouses, life partners, parents, children, siblings, and grandparents);

iv. Any person directly or indirectly controlling or controlled by the Promoter.

4.     CAMPAIGN PERIOD

The Competition will run from 5 May 2025 to 11 July 2025 ("Campaign Period"). No entries received outside the Campaign Period will be accepted.

5.     ENTRY REQUIREMENTS

To enter, Participants must:

5.1 Complete the following steps:

A.                 Download the Gain For Me App from the Google Play Store or Apple App store and follow the prompts to register your user profile on the App;

B.                 By participating in the Synapser (Pty) Ltd / Gain For Me Promotional competition, you are deemed to have read and agreed to these Synapser (Pty) Ltd / Gain For Me Competition Terms & Conditions 2025.

C.                 Complete the Gain For Me General Profile Survey.

D.                 In the Rewards Centre: Watch the 30 second Gain For Me Advert, look out for the code near the end of the advert and enter the code as directed;

E.                  In the Rewards Centre:  Complete the Banking and Mobile Device Survey.

F.                  In the Rewards Centre: Click on the 3 dots found at the bottom right of the page and then click on the wallet icon;

G.                Register your digital identity by performing a facial recognition and ID or passport scan as prompted;

H.                 On the Wallet page: Click on “Transfer your Funds’’ and link your Shoprite Money Market Account and Xtra Savings membership to the App as prompted;

I.                    After completing steps A – H, you are automatically entered in the draw for a chance to win 1 of 10 weekly R1000 Shoprite vouchers.

J.                   Refer Now (see bottom of Rewards Centre): If you refer a friend who successfully completes steps A-H and submits their referral code (“Successful Referral”), you stand a chance to win 1 of 10 Ecco 43-inch LED Full HD TVs (retailing for ±R2999.00 each) awarded weekly to the highest number of ‘successful referrals’, or 1 of 3 x Samsung A06 mobile phones (retailing for ±R2499 each) and 7 x HMD C22 Nokia mobile phones (retailing for ±R1499.00 each) awarded weekly to the second highest number of ‘successful referrals’.

5.2 Use a mobile number:

i.                  That is owned and registered in the name of the Participant;

ii.                  That is contactable during office hours (08h00–17h00, Monday to Friday);

iii.                  That is not used for multiple entries. Each Participant may only use one mobile number to enter the Competition.

·        The Promoter may disqualify any entry submitted with an unregistered or duplicated number and reclaim any Prize awarded based on false or misleading information.

·        Participants may only submit one entry which will be verified against the users ID or passport.

6.     VERIFICATION & PARTICIPATION

By entering:

   i.                  You confirm that all submitted information is true, current, and complete.

 ii.                  All entries are subject to verification.

iii.                  The Promoter reserves the right to reject any entry or disqualify any Participant suspected of fraud or non-compliance with these Competition Terms and Conditions.

7.     PRIZES AND WINNERS

7.1 Weekly Shoprite voucher draw.

   i.                  100 x Shoprite vouchers to the total value of R100,000.00 are up for grabs during the Campaign Period:

·        10 winners will be drawn on a Monday of every week during the 10-week Period.

·        Each winner will receive a Shoprite voucher to the value of R1,000, which will be loaded in (and can only be redeemed via) the winners’ Shoprite Money Market Accounts.

·        Winners will be randomly selected using a verifiable system.

·        10 winners per week × R1,000 each = vouchers to the total value of R10,000 per week.

·        10 weekly draws will occur during the Campaign Period.

·        Winners will be randomly drawn using a verifiable system.

Draw dates:

7.2 ‘Successful Referral’ product prizes:

i. 10 x Ecco 43-inch LED Full HD TVs (retailing for ±R2999.00 each) sponsored by Match Business Partners (Pty) Ltd, awarded weekly to the person with the highest number of ‘successful referrals’;

ii. 3 x Samsung A06 mobile phones (retailing for ±R2499 each) sponsored by Shoprite Checkers (Pty) Ltd, and 7 x HMD C22 Nokia mobile phones (retailing for ±R1499.00 each) sponsored by the Promoter, awarded weekly to the second highest number of ‘successful referrals’;

iii. Refer a friend who successfully completes steps A-H (“Successful Referral”), as detailed in clause 5.1, and stand a chance to win 1 of 10 Ecco 43-inch LED Full HD TV awarded weekly to the highest number of ‘successful referrals’, or 1 of 7 Samsungs and 3 HMD C22 Nokia’s awarded weekly to the second highest number of ‘successful referrals’.

8.     WINNER SELECTION & VERIFICATION

i. Winners will be contacted via the Gain For Me App or WhatsApp on the mobile number used to enter the Competition, within thirty days after the Campaign Period ended.

ii. The winner notification message will include a link to a verification form.

iii. Winners must complete this form within 48 hours to claim their prize.

iv. If the winner does not respond in time, their prize is deemed forfeited and a replacement winner will be drawn.

 v. Verified winners will receive a confirmation via the Gain For Me App or WhatsApp within 7 working days.

vi. Product prize delivery via courier may take up to thirty working days after final confirmation.

vii. Winners must provide a valid ID, name, surname, address, and email for verification.

viii. Participants stand a chance to win only one prize each in the Competition.

9.     PUBLICITY & CONSENT

i. Winners may be requested (but not required) to appear in marketing material or promotional content, including photographs or videos shared online, in print, or on-air.

ii. Participants will have the right to decline such publicity in writing.

10. LIABILITY LIMITATION

Neither the Promoter nor the prize sponsors will be liable for:

i. Late, lost, incomplete, corrupted, or misdirected entries or SMS / WhatsApp or In App communications;

ii. Technical failures or delays in transmission;

iii. Any damage or loss (direct or indirect) arising from participation in the Competition or use of a Prize.

11. INDEMNITY

To the extent permitted by law, all Participants agree to indemnify the Promoter and its agents, employees, prize sponsors and suppliers from any claims or damages arising from their participation in this Competition or acceptance of any Prize.

12. FRAUD, ERRORS & TERMINATION

i. The Promoter reserves the right to cancel or modify the Competition if fraud, technical failures, or any other factors impair the integrity of the Competition.

ii. The Promoter may terminate the Competition early due to events beyond its control (force majeure).

13. DATA PROTECTION AND POPIA

   i.                  By entering, Participants consent to the Promoter processing their personal information for the purposes of giving effect to the Competition, including:

·  Entry validation;

·  Winner contact and verification;

·  Publicity (if consented to);

·  Prize delivery; and

·  Marketing communications (opt-out at any time).

 ii.                  Personal data is collected and used in line with the Protection of Personal Information Act, 2013 (POPIA).

iv.                  Participants may request access to or correction of their personal information at any time by emailing info@synapser.com.

14. GENERAL CONDITIONS

   i.                  Prizes are not exchangeable or transferable for cash.

 ii.                  The Promoter and prize sponsors will be entitled to substitute an unavailable prize with one of equal or greater value.

iii.                  Any tax implications are the sole responsibility of the winner.

iv.                  The Promoter’s decision regarding winner draws and prize awarding is final. No correspondence will be entered into.

 v.                  These Terms shall be governed by the laws of South Africa.

vi.                  If any clause is held unenforceable, the rest of the Terms will still apply.
